Training on the International Oil Pollution Compensation Scheme for the Jordanian maritime authorities
The course was delivered from 1 to 5 December at the headquarters of the Jordan Maritime Commission (JMC) in Aqaba to an audience comprising participants from the JMC, Aqaba Development Corporation, Arab Ship Management, Prince Hamza Oil Spill Combat Center, and Aqaba Port Marine Services Company.
The trainers provided insights into the development and salient features of the legal regime established by the 1992 Civil Liability Convention and the 1992 Fund Convention, as well as the main principles and regulations covering liability and compensation for damage for pollution caused by ships.
Different roles and responsibilities of the potential stakeholders in a pollution case, such as the IOPC Fund Secretariat, P&I Clubs, ITOPF, INTERTANKO, International Chamber of Shipping (ICS), were explained using examples of legal issues pertaining to civil liability and compensation regimes.
Case studies were also utilised to demonstrate the correct analysis of factual and legal circumstances by applying principles of tort law, relevant civil liability conventions, legislation, and case law to determine polluters’ liability and compensability of claims. Additionally, the steps and requirements for handling claims by the IOPC Fund Secretariat and the settlement process were discussed.
This training constitutes another assistance activity aimed at building up the Project’s beneficiaries’ national capacities for pollution response.
